Membership Agreement

These Terms & Conditions explain your DUAL membership, how payments work, how to cancel and the responsibilities of both you and DUAL.

Your Membership At A Glance

Unless your chosen membership is expressly described otherwise when you join, your DUAL membership is a monthly rolling membership.

  • Membership fees are charged monthly in advance.
  • Your membership automatically renews every month.
  • There is no fixed minimum term unless specifically stated when you join.
  • Your membership continues until cancelled in accordance with these Terms.
  • To prevent your next monthly payment, DUAL must receive your cancellation request at least 7 clear days before your next scheduled payment date.
  • Stopping attendance does not cancel your membership.
  • Cancelling your payment instruction does not cancel your membership.

1. Agreement

This is an agreement between you, the member, and DUAL Strength and Fitness Ltd, a company registered in England and Wales under company number 09047434.

Our registered office is DUAL Strength and Fitness Ltd, Unit B Blatchford Road, Horsham, West Sussex, RH13 5QR.

By completing the online joining process, registering as a member or otherwise accepting these Terms, you agree to be bound by this Membership Agreement.

You should only join if you are willing to accept these Terms.

2. What You Are Signing Up For

Unless your chosen membership is expressly described otherwise during the joining process, you are purchasing a monthly rolling membership.

Your Membership Agreement includes:

  • these Terms & Conditions;
  • your chosen membership type;
  • the membership price;
  • the benefits shown to you when joining;
  • any specific terms applicable to your membership; and
  • DUAL's reasonable gym rules and policies.

Membership is personal to you and cannot be transferred, sold, shared or used by another person.

3. Starting Your Membership

Your Membership Agreement starts when you accept these Terms and DUAL accepts your membership application and payment.

Your first membership payment will normally be taken when you join unless another start date is agreed.

By joining, you agree to pay any membership fee, joining fee, administration fee or other applicable charge clearly shown before completing your purchase.

4. Membership Access

You may use the facilities included in your chosen membership while your membership is active and payments are up to date.

You must also:

  • comply with these Terms;
  • comply with DUAL's gym rules;
  • follow reasonable staff instructions; and
  • use the facilities safely and appropriately.

5. Managing Your Membership

You are responsible for managing your membership, including requests to cancel, freeze or amend it.

Formal membership requests should be sent by email to:

Requests made verbally, over social media, by text or directly to an individual staff member do not constitute formal notice unless DUAL expressly confirms that the request has been processed.

6. 14-Day Cooling-Off Period

Where you enter into your Membership Agreement online or otherwise at a distance, you may have a statutory right to cancel within 14 days of the day after the contract is entered into.

To exercise this right, you must clearly inform DUAL that you wish to cancel. You can do this by emailing:

If you ask for your membership and gym access to begin immediately during the 14-day period, you expressly request that DUAL begins supplying the service before the cooling-off period expires.

Where permitted by law, DUAL may charge a proportionate amount for the service supplied before you exercise your cancellation right.

Nothing in these Terms affects your statutory consumer rights.

8. Freezing Your Membership

DUAL may allow certain memberships to be temporarily frozen.

  • Freeze requests must be made in writing.
  • Freezes cannot normally be backdated.
  • DUAL may request reasonable evidence where appropriate.
  • The start and end date of an approved freeze will be confirmed to you.
  • Gym access may be suspended during the freeze period.
  • Payments will resume when the agreed freeze ends.

A membership freeze is not the same as cancellation.

9. Membership Payments

  • Membership fees are normally payable monthly in advance.
  • Your first payment is normally collected when you join.
  • Subsequent payments are taken on or around your scheduled monthly payment date.
  • Your membership renews automatically each month until cancelled.
  • You are responsible for maintaining a valid payment method.

Membership fees remain payable regardless of how often you use the gym.

10. Failed Or Missed Payments

If a payment is declined, reversed, cancelled or otherwise not received, DUAL may contact you and request payment of the outstanding balance.

A failed payment does not automatically terminate your membership and does not constitute notice of cancellation.

DUAL may temporarily suspend gym access while membership payments remain overdue.

Where reasonable and permitted by law, DUAL may charge an administration fee reflecting reasonable costs actually incurred in dealing with failed or overdue payments.

11. Recovery Of Outstanding Amounts

Where money legitimately remains due under your Membership Agreement, DUAL may take reasonable steps to recover the amount owed.

This may include contacting you directly or referring the matter to an appropriate debt recovery provider.

Where permitted by law, you may also be responsible for reasonable and proportionate costs actually incurred in recovering overdue sums.

12. Membership Price Changes

DUAL may change membership prices from time to time.

Where we increase the recurring price of an existing membership, we will give reasonable advance notice, normally at least 30 days.

If you do not wish to continue at the new price, you may cancel your membership in accordance with Section 7 before the new price takes effect.

13. Communications

DUAL may send important membership, payment, operational and safety communications using the contact details registered to your account.

You are responsible for keeping your contact details accurate and up to date.

Marketing communications are separate from essential membership communications and may be opted out of in accordance with applicable law.

14. Your Responsibilities

  • Provide accurate information when joining.
  • Keep your contact details up to date.
  • Use equipment properly and safely.
  • Ask staff for help if you are unsure how to use equipment.
  • Follow reasonable health and safety instructions.
  • Comply with the DUAL Membership Rules.
  • Respect the gym, equipment, staff and other members.

15. Member Behaviour

DUAL is committed to maintaining a welcoming, safe and respectful environment.

Members must:

  • treat staff, members and visitors with respect;
  • follow reasonable staff instructions;
  • use equipment safely;
  • re-rack weights and leave equipment appropriately;
  • wear suitable clothing and footwear;
  • not deliberately damage equipment or property;
  • not smoke or vape inside the premises;
  • not create an unsafe environment through alcohol or illegal drug use; and
  • not engage in abusive, threatening, discriminatory, intimidating or sexually inappropriate behaviour.

16. Suspension Or Termination By DUAL

DUAL may refuse, suspend or terminate membership where there is a reasonable and legitimate reason to do so.

Examples may include:

  • abusive or threatening behaviour;
  • violence or intimidation;
  • harassment or discrimination;
  • serious or repeated breaches of gym rules;
  • damage to equipment or facilities;
  • theft or fraudulent activity;
  • sharing membership access;
  • persistent failure to pay fees;
  • serious health and safety breaches; or
  • conduct that creates an unsafe environment.

Serious misconduct may result in immediate suspension or termination.

17. Access, Guests & Day Passes

  • Only the named member may use a membership.
  • Memberships must not be shared.
  • Guests must have valid authorised entry or a day pass.
  • You must not allow another person to enter using your membership credentials.
  • Unauthorised access may result in suspension or termination.

18. Opening Hours & Temporary Closures

DUAL may change opening hours and may operate reduced hours on bank holidays, Christmas, New Year or other occasions.

We may temporarily close all or part of the gym for maintenance, refurbishment, cleaning, equipment installation, health and safety reasons, emergencies or circumstances outside our reasonable control.

Reasonable temporary changes will not normally entitle a member to a refund. Where a substantial closure occurs, DUAL will consider any appropriate membership adjustment in accordance with applicable consumer law.

19. Health & Safety

You are responsible for considering whether you are physically able to participate safely in exercise.

If you have concerns about whether exercise is appropriate for you, seek suitable professional medical advice.

You must use gym equipment safely and follow reasonable safety instructions.

20. CCTV, Photography & Filming

DUAL may operate CCTV for legitimate purposes including security, safety and crime prevention.

CCTV will be operated in accordance with applicable data protection law.

DUAL may occasionally take photographs or video for marketing purposes. Where an identifiable individual is the intended subject, appropriate consent or another lawful basis will be used where required.

Members taking photographs or video must respect the privacy of other gym users.

21. Personal Belongings

You are responsible for your personal belongings while using DUAL.

Where lockers or storage facilities are provided, members should use them appropriately and avoid bringing unnecessary valuables.

Nothing in these Terms excludes or limits DUAL's liability where it would be unlawful to do so.

22. Liability

DUAL will provide its services with reasonable care and skill.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Members remain responsible for exercising reasonable care and following safety instructions.

Nothing in these Terms affects your statutory rights.

23. Personal Trainers & Other Services

Personal trainers, therapists or other professionals operating from DUAL may provide services independently from DUAL.

Where you purchase services directly from an independent provider, a separate agreement may exist between you and that provider.

Where DUAL supplies the service directly, DUAL's legal responsibilities apply.

24. Data Protection

DUAL will process personal information in accordance with applicable UK data protection law and our Privacy Policy.

Personal information may be processed where reasonably necessary to administer memberships, process payments, provide access, communicate membership information, maintain security and meet legal obligations.

25. Changes To These Terms

DUAL may make reasonable changes to this Membership Agreement where there is a legitimate reason.

Reasons may include:

  • changes in law or regulation;
  • health and safety requirements;
  • changes to facilities or services;
  • membership administration changes;
  • payment or technology changes; or
  • reasonable operational requirements.

Where a change materially affects your membership rights or obligations, reasonable advance notice will be provided where appropriate.

26. Promotions & Discounted Memberships

DUAL may offer promotional or discounted memberships from time to time.

Promotional memberships may have additional terms which will be displayed before purchase.

Unless expressly stated otherwise, a promotional membership that converts to a monthly rolling membership will continue automatically at the applicable recurring price until cancelled.

27. Complaints

If you are unhappy with any aspect of your membership or our service, please contact us so we have an opportunity to investigate.

28. Your Statutory Rights

Nothing in these Terms is intended to exclude, restrict or reduce any statutory rights that you have as a consumer.

If any provision conflicts with a legal right that cannot lawfully be excluded, your statutory rights take priority.

29. General Terms

  • Your Membership Agreement is personal to you.
  • If one provision is found unenforceable, the remainder of the agreement will continue to apply.
  • Failure by DUAL to immediately enforce a term does not waive that term.
  • This agreement is governed by the laws of England and Wales.
  • You should save a copy of these Terms for your records.

Important Membership Acknowledgement

I understand that, unless expressly stated otherwise, I am purchasing a monthly rolling DUAL membership.

I understand that my membership automatically renews each month and the applicable membership fee will continue to be collected until I cancel.

I understand that DUAL must receive my cancellation request at least 7 clear days before my next scheduled payment date to prevent that payment being collected.

I understand that if I cancel fewer than 7 clear days before my payment date, the next payment may still be collected and my membership will continue until the end of the resulting paid membership period.

I understand that stopping attendance, cancelling my payment instruction or allowing a payment to fail does not itself cancel my membership.

I confirm that I have read and agree to DUAL's Membership Terms & Conditions.
